Program Overview The MyWem Loyalty Program (the “Program”) is a loyalty program which is operated by West Edmonton Mall Property Inc. or its subsidiaries and affiliated companies (collectively, “WEM”) and is subject to any exceptions noted herein, open to any user who is over the age of majority in the jurisdiction of their residence. At this time, participation in the Program is not open to residents of Quebec. There are no membership fees associated with the Program. Loyalty points earned in the Program are promotional and have no cash value. Unless otherwise provided for in these Program Rules, your points and your account are personal to you and may not be sold, transferred, assigned to or shared with family, friends or others (including death or divorce), and are not to be used by you for any commercial purpose. The Program allows participants who register in accordance with these rules, terms and conditions (the “Program Rules”) to collect points to be used in accordance with these Program Rules.
Eligibility for the Program Membership in the Program is for individuals who meet all eligibility requirements, including those in paragraph 1. No corporation, trust, partnership or other entity may hold membership in the Program. Minors who are under the age of majority in the place of residence are not permitted to use the WEM App or Portal or participate in the Program without the permission of their parent or legal guardian. If you are a minor, please do not register for the WEM App or Portal without the consent of your parent or guardian.
Registering for the Program Download the MyWEM App to your Android or iPhone device or visit the Portal. Follow the prompts to create an account and register for the Program. The registration process may require you provide the following information: username, password, email address, first and last name and date of birth. Your account may also be registered at the Portal, however you may only have one (1) account that is personal to you.
Earning Points: Once you are registered in the Program, there are multiple avenues through which you can obtain points for participation in the Program. These avenues are as follows:
Purchases made at any WEM Attraction ;
Purchases at any of WEM’s participating retailers. Participants in the Program will scan their receipts and if the minimum spending requirement is met, points will be rewarded;
Via various social media interactions (such as following WEM on Instagram);
By staying at WEM’s Fantasyland Hotel or WEM Inn (points may be earned via the registration process);
By refer a friend programs at participating WEM stores;
By certain advertised promotions via promotions cards or codes;
Via Bluetooth Beacons (30 minutes or more). Specific Program details such as how points are calculated and attributed to which WEM Attractions and how many and how those points are burned (redeemed), along with any other constraints or minimum spending requirements are as attached in the Schedule “A” which forms part of the Program Rules and is specifically incorporated herein.
Redeeming (Burning) Points: The methods of redeeming points in the Program are as follows:
Using points earned to purchase rewards;
Using points to bid on rewards; and
Using points to purchase tickets for a reward contest.
To ‘redeem’ or ‘burn’ means to use your earned points to pay, or gain admission to, various WEM attractions. For the specific ways and allocations of points for the various WEM attractions please see the attached Schedule “A”. You can redeem the points by emailing the Program’s marketing team at firstname.lastname@example.org. We may change the minimum redemption amounts or redemption increments at any time. We may also, or instruct others acting on our behalf, offer you special redemption promotions from certain retailers, or from certain attractions, such as an increase in the value of points or a lower minimum amount for redemption. These Program Rules, and any additional terms and conditions that accompany any such offer, would apply to any such promotions. Points that you have earned while making a purchase or via other methods such as social media interaction can only be redeemed for a subsequent transaction. Only one redemption will be processed per transaction. No cash back will be provided on any redemptions. The points that you redeem will be deduced from your account in the order that they were earned. Any remaining points in your account can be redeemed at a later date. There is no provision for partial redemptions in the Program, except in the case of Food and Beverage vouchers which may allow for a balance when redeemed by a participant.
Further Constraints and Exclusions In addition to the constraints and exclusions noted in Schedule “A”, the following are additional constrains and exclusions when burning (redeeming) points in the Program:
Points cannot be earned or redeemed except as provided for in these Program Rules;
Points are not earned on the portion of a transaction that is being paid for by redeeming points;
At this time there is no application of the Program to the WEM Attraction known as ‘Ed’s Bowling’, however we reserve the right to amend or alter these Program Rules to include Ed’s Rec Room in the future;
With respect to the WEM Attraction ‘ Marine Life’ points can only be earned if participants purchase a combo for the Sea Life Caverns and the Sea Lion Show as set forth in Schedule “A”;
For WEM Attractions ‘Professor WEM’s Adventure Golf’, ‘Dragon’s Tale’, ‘Crystal Labryinth’,’ Santa Maria’ and the ‘Ice Palace’, points can only be earned if participants purchase a combo for Dragons Tale and Crystal Labryinth as provided for in Schedule “A”;
Fantasyland Hotel and WEM Inn – there is a different structure for earning points in the Program. At the end of a guests stay, guests take their folio and scan it using the Ziploop function. Guests are then rewarded 9.1% of their total dollar stay in the form of points. For example: $1000 = 91 points.
Other Earning and Redemption Program Rules Any contests or similar promotions of any type made available for participation in the Program will be governed by specific rules and regulations that are separate from and in addition to these Program Rules. By participating in any such contest or similar promotions, you agree to be subject to those specific contest rules and regulations, which rules and regulations may vary these Program Rules and which are incorporated by reference into these Program Rules. If there is a dispute about the number of points earned, redeemed, deducted or corrected, our records will be considered accurate unless you contact us within seven (7) days from the relevant transaction date to report a concern regarding your points account balance. If we do not hear from you within such time frame, you shall be deemed to agree with us about the number of points in your account according to our records. WEM accepts no liability for any errors in the points balance displayed on a receipt or in your account. In the event points are awarded to your account in error at any time, we reserve the right at any time to deduct the number of points awarded to you in error at any time and without notice to you. We are under no obligation to redeem points added to an account in error. We are not responsible for any errors that may occur in the sending of points or if there is a delay in sending or receiving points. You are responsible for all redemptions on your account of your points, including without limitation redemptions made on your account as a result of unauthorized access to your account such as due to a failure to safeguard your account.
Voluntarily Closing Your Account If you choose to close your account, you will have to redeem (burn) any points accumulated in your account prior to cancelling your account. Any points left in your account post-cancellation will not be retrievable by you and will be removed from your account.
Governing Law These Program Rules are governed by the laws of the Province of Alberta and federal laws applicable therein.
Changes to the Program Rules and the Program These Program Rules may be amended from time to time and you should check the WEM Portal regularly for updates. We reserve the right to update, change or otherwise alter these Program Rules, or the Program, in our sole and unfettered discretion, without notice or consent.
We also reserve our right to modify, or amend, all or any one part of the Program, its eligibility requirements or otherwise, including without limitation the following;
The eligibility conditions for participating in the Program;
The manner and extent to which an eligible participant participates in the Program;
the manner and rate at which points may be earned; and
The manner and extent to which points may be redeemed (burned).
In the event that these Program Rules, or any aspect of the Program is restricted, changed, modified, or changed we will provide you notice by posting the amended Program Rules online at www.mywem.ca. Your continued participation in the Program after such Program Rules are amended, will constitute your express consent to any amendments to these Program Rules, or any other aspects of the Program. Should you not agree with any such amendments you may cancel your participation in the Program.
Termination of the Program If events beyond our control materially affect our ability to operate the Program, as determined by us in our sole and unfettered discretion, the Program may be suspended or terminated without notice to you and without WEM or any of its affiliates incurring any liability or obligation whatsoever. WEM reserves the right to terminate your participation in the Program, or any portion thereof, at any time, and for any reason whatsoever, on notice to you via email.
Expiration Policy Without notice to you, WEM reserves the right to terminate and make ineligible for participation in the Program any account that has been inactive for twelve (12) months. For the purposes of these Program Rules, ‘inactive’ shall be defined as no point activity on the account whatsoever. In the event that your account is rendered inactive, then all accumulated points in your account are void.
General The Program is offered by West Edmonton Property Inc. which may also be referred to in these Program Rules as “our”, “we” and “us”. By participating in the Program, or any aspect thereof, you (and your parent or legal guardian on your behalf, if you are under the age of majority in your jurisdiction of residence) agree to be bound by these Program Rules. You are responsible for protecting and keeping your account secure and any password or security questions, if any, used in relation to your account. We reserve our right to sell or transfer the Program, or any part of the Program, to a related corporation or to a third party, to merge with another entity or party or to engage in any form of corporate or other financing transaction. If any of the information you were required to submit when you registered for your account (such as you name), you must update your account. We reserve the right to refuse to allow you or any person to join the Program for any reason in our sole and unfettered discretion, including without limitation for not meeting eligibility criteria or for having had your membership cancelled on a previous occasion. By participating in the Program, you (and your parent or legal guardian) agree to release and discharge us, our affiliates and subsidiaries and any third parties participating in the Program and each of their respective officers, directors, agents, representatives, successor and assigns from any loss, liability, claim, demand, damage or expense relating in any way to the Program, your participation in the Program and /or related to the redemption and use/misuse of any item obtained through the redemption of points or otherwise in connection with the Program whatsoever.
Dispute Resolution In the event of any dispute arising under this agreement, you agree to submit to the jurisdiction of the courts in the Province of Alberta, Canada.
